On November 19, 2020, the Board of Directors approved the following recommendations from the MLS Committee to amend the MLS Rules, as outlined below, and are effective immediately. For questions, please call 423.698.8001 and ask to speak with MLS Director Tonya Bell or MLS Coordinator Rheta Beck.
As outlined below, the MLS Rules, Section 1.2.6. Listing Status Definitions for Temp Off Market was amended to be consistent with the intent that listings in this status are not to be shown and for alleged violations of the showing prohibition to be handled in the same manner as those for Coming Soon listings:
Section 1.2.6. Listing Status Definitions
Temp Off Market: A listing for which the Participant has a current listing agreement and the Seller has requested be withdrawn temporarily from the market prior to the expiration date of the listing agreement. With the Seller’s written permission, the Participant may change the listing to another status at any time prior to the expiration date. A Withdrawn Temp Off Market listing automatically will change to Expired at midnight on the date of expiration. Listings in this status are not available to be shown may not be shown to anyone, including but not limited to other MLS Participants/Subscribers, other real estate licensees, unlicensed assistants, clients and customers of the listing brokers or other licensees, and/or members of the public**. Days on Market cease to accumulate.
**Alleged violations of the terms and conditions outlined above for Temp Off Market listings shall be referred to the Chief Executive Officer for appropriate action in accordance with the professional standards procedures established in the Code of Ethics and Arbitration Manual. Sanctions which may be imposed on users include suspension of MLS rights and privileges and a fine not to exceed fifteen thousand dollars ($15,000).
As outlined below, the MLS Rules, Section 1.2 Detail on Listings Filed with the Service was amended to clarify the determining factors for eligibility of listings entered in Flexmls versus Catylist:
MLS Rules, Section 1.2 Detail on Listings Filed with the Service, e. Zoning: Zoning, when available, shall determine the Property Type in which a listing may be entered. If a property is zoned in more than one classification, the listing may be entered into both Property Types. For determining the MLS platform (commercial and/or residential) for which vacant land is to be entered, refer to Land Use as defined by tax records. Section 1.1.a and 1.1.b shall determine which MLS platform (commercial and/or residential) for which all other property types a listing may be entered. For entering a listing in the incorrect Property Type MLS platform (commercial and/or residential), the listing will be removed by the MLS and noticed provided to the listing agent that the listing shall be entered within the required timeframe as outlined in Section 1.
