Designed to meet the NAR Code of Ethics training requirements, this course is Ethics as only Trista can teach it. Examining how the NAR Code of Ethics intersects with state and federal law, this course provides a new perspective on the Code and risk management in the practice of real estate. Providing adequate time for class participation and discussion, this course asks “what would you do?” and applies the answers to current case studies and examples.

When the Sherman Act began regulating antitrust behaviors in the United States, the union had 42 states and women were 30 years away from being able to vote. A lot has changed over the past 130 years but in his Executive Order on Promoting Competition in the American Economy, President Biden issues a reminder that antitrust continues to be a problem in real estate. This session examines the 3 primary federal laws regulating antitrust and applies them to situations happening today.

Whether the device is there for the seller's peace of mind, or to provide the seller with an advantage at the negotiation table, agents need to have a plan in place to handle the “nanny cam conundrum.” With nearly 80% of all web traffic being video-driven, the use of drones to capture amazing footage of a property is on the rise. This course addresses the question: What are the rules that apply to drone usage and what should agents know about them?

Occasionally, you may get a showing request from an appraiser or real estate licensee who isn’t an MLS user affiliated with one of our eKey reciprocity partners. So, we’ve enabled a new feature in your Supra eKey – Single Access!
Single Access allows listing agents on a case-by-case basis to invite the property owner, or out-of-area appraisers or real estate licensees to access a keybox at a specific date/time. Single Access offers:

Secure, limited, and non-transferable access
-
Access credentials delivered to the out-of-area licensee’s smartphone
-
Easy to view, modify and manage granted access within the Supra eKEY app
-
Out-of-area licensees have a “one-button” (i.e., Obtain Key) within the Supra eKEY app that provides easy access to obtain keys from Supra lockboxes.
To ensure our eKey holders limit the use of Single Access to authorized persons, the MLS Rules include the following:
Section 18.12.a. Supra’s Managed Access is available to any Participant or Subscriber Keyholder (i.e., listing agent) to provide access to the Keyholder’s keybox, provided the person to whom access is granted is the property owner or:
i. Holds an active real estate or appraiser license in the state where the property is located; and
ii. Is not an MLS Participant or Subscriber in this MLS or any MLS with whom Greater Chattanooga REALTORS® has e-Key reciprocity.
When granting Managed Access, Keyholder shall enter in the Supra system the name and contact information of the real person to whom access is being granted. Failure to abide by this Section 18.12.a. shall result in a:
i. Five hundred dollars ($500) for the first offense:
ii. Seven hundred and fifty dollars ($750) for the second offense; and
iii. One thousand dollars ($1,000) for the third offense.
For any fourth or more violation, the offender shall appear before the MLS Committee for consideration of discipline to be imposed. Said discipline shall be limited to those outlined in Section 7 of hte MLS Rules.

Why does someone obtain a real estate license? The answer really has nothing to do with the right to buy or sell real estate. Anyone with enough money or financing can do that! A real estate license is all about representation. The license permits someone to represent another party in the purchase or sale of real estate, to safeguard their interests, to treat them honestly, to serve them with professionalism. Agency at its heart is not a difficult or complex concept. It’s all about representing a consumer conscientiously, doing so with the consumer’s understanding and written agreement, steering clear of any conflicts of interest, and ensuring that—at any time in the transaction—everyone in the transaction knows whom the licensee does and doesn’t represent. This course takes you through common misconceptions about agency law in Tennessee, as well as a section-by-section presentation of the law itself with a brief commentary on each section.
